  • Limited tax liability (§ 49 EStG): as a non-resident you remain liable for tax on German real estate — your place of residence does not change that.
  • 10-year speculation period (§ 23 EStG): a gain on a sale within ten years of purchase is generally taxable; after ten years it is not.
  • Owner-occupation exemption: if you used the property yourself in the year of sale and the two preceding calendar years, the gain can be exempt even within the period.
